Terms of Service

Revision: DRAFT · updated: —

This is a draft, not a document in force. It exists to fix the structure and the product rules that are already implemented in code. Before publication a lawyer has to go through it: this is a contract with businesses in the EU, covering refunds and the processing of personal data, and a mistake here costs more than any bug. Places where details get filled in are marked as […].

1. Who provides the service

The service is provided by [full legal entity name], [NIP / REGON], address [address], contact [email]. Referred to below as "we".

2. What you actually get

Access to a web application for running social media accounts and producing media: multiple brands, a calendar and publishing, an inbox, analytics, and image and video generation. What is included depends on your plan and is described on the pricing page.

3. Credits

Generation is paid for in credits. The rules that apply in the product:

  • Plan credits are granted each billing period and do not roll over into the next one.
  • Credit packs bought on top of a plan do roll over and stay valid for 12 months from the date of purchase.
  • Plan credits are spent first, purchased packs after them.
  • The price of an operation is known before it starts and is fixed for the whole billing period: a supplier's price change mid-period does not reach you.
  • A failed generation is not charged. A partial one is charged in proportion to what you received.

4. Your content and your accounts

The content you upload, and the material created for you in the service, belongs to you. We process it only in order to provide the service.

By connecting social accounts you confirm that you have the right to manage them. The platforms' own rules (Meta, LinkedIn, TikTok) apply on top of these terms, and we cannot guarantee features that a platform has changed or restricted.

5. Generated material

Material is produced by third-party models. We do not guarantee that a result is unique and we do not check it for infringement of anyone's rights — checking before publication is on your side. Labelling material as AI-generated where a platform or the law requires it is also your responsibility.

6. What you may not do

  • Create material that breaks the law or a platform's rules.
  • Pass off generated images of real people as genuine.
  • Automate activity in accounts you have no right to manage.
  • Resell access to the service without a separate agreement.

7. Payment and refunds

Payment is taken in advance for the chosen period. [Refund procedure and cooling-off period — to be agreed with a lawyer: consumers in the EU have separate rules, and B2B rules differ.]

8. Availability and limits of liability

We do not promise uninterrupted operation: the service depends on third-party model providers and on social platforms. [Wording of liability limits — for the lawyer.]

9. Termination

You may stop using the service at any time. We may suspend access in case of a breach of these terms or non-payment, with notice in advance, except where delay would create a risk.

10. Changes

We give notice of material changes in advance. Changes do not apply retroactively to a period already paid for.
